These terms apply when you buy from chinuppets.com. Please read them before you order. By placing an order you confirm you accept them.
1. Who you are buying from
ChinUp is a trading name of Jacob Orsborn-Smith, a sole trader in the United Kingdom. Contact us at support@sitework.uk and we will reply within one working day.
Insert the trading address here. The Consumer Contracts Regulations 2013 require a UK distance seller to give a geographical address before the customer buys, and this is one of the three pages it has to appear on.
2. Your statutory rights come first
You are buying as a consumer, so the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply. Nothing in these terms limits those rights. Anything below that would be unfair under the Consumer Rights Act simply does not bind you, and the rest of the terms still stand.
3. Who can order
You must be 18 or over and ordering for delivery to a United Kingdom address. We do not currently ship outside the UK.
4. The product
We sell a buoyancy jacket for dogs with a chin rest, in a range of sizes and colours. We describe it as accurately as we can, but photographs and screen colours vary, and the sizing chart is a guide based on chest girth rather than a guarantee of fit. Measure your dog before ordering. If the size is wrong, the cancellation right in section 8 covers you.
5. Safe use, and what the jacket is not
This matters more than anything else on the page.
- A ChinUp jacket is a swimming aid, not a lifesaving device, and it is not a substitute for supervision. Always stay with your dog in and around water.
- We do not publish a certified buoyancy rating and we make no claim that the jacket will keep any particular dog afloat in any particular conditions.
- Check the fit and the fastenings before every use. Do not use a jacket that is damaged, worn, or the wrong size.
- It is not designed for use in strong currents, open sea conditions, or as equipment for a dog that cannot swim at all.
- If your dog has a medical condition affecting mobility or breathing, ask your vet first.
Nothing in this section limits our liability for death or personal injury caused by our negligence, or for defective products under the Consumer Protection Act 1987.
6. How an order is made
Your order is an offer to buy. The confirmation email you get straight after checkout acknowledges the order; it does not yet accept it. The contract is formed when we email you to say your order has been dispatched.
We may decline an order if the item is out of stock, if we identify a pricing or description error, if we cannot deliver to your address, or if we suspect fraud. If we decline after you have paid, you get a full refund within a few working days and we will tell you why.
7. Prices and payment
Prices are shown in pounds sterling and include any VAT that applies. UK delivery is free, so the price at checkout is the total you pay, with no surcharges added afterwards.
Payment is taken at checkout through Stripe on its own hosted page. We never see or store your full card number. If a price is obviously wrong and you could reasonably have spotted it, we do not have to sell at that price; we will contact you before doing anything.
8. Delivery
We dispatch within 2 working days and orders typically arrive 5 to 8 working days from the day you order. You get a tracking link by email at dispatch. If we cannot meet that timeframe we will tell you, and in any event we will deliver within 30 days of the contract unless you agree otherwise, as the Consumer Rights Act requires.
Risk passes to you when the goods are delivered to you, or to a person you have named to receive them. If a parcel is lost in transit, that is our problem to fix, not yours. Full detail is on the delivery and returns page.
9. Changing your mind
You can cancel for any reason within 14 days of the day you receive your order, and you then have a further 14 days to send it back. We refund within 14 days of receiving the goods back, using the same payment method you used. We pay the return postage.
Please return the jacket in a condition that lets us resell it. You may handle it as you would in a shop, and trying it on your dog is fine. If you reduce its value by more than that, for example by using it in water for a fortnight, we may deduct a reasonable amount from the refund. How to cancel, including the model cancellation form, is on the delivery and returns page.
10. If something is faulty or wrong
Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. If yours is not:
- Within 30 days you can reject it and get a full refund.
- After 30 days and up to six months we will repair or replace it. If that does not resolve it, you can claim a refund, which may be reduced to reflect the use you have had.
- After six months your rights continue, though it is for you to show the fault was present at delivery.
We pay postage both ways on faulty or incorrect items. Email support@sitework.uk with your order number and a photograph and we will sort it.
11. Our content
The ChinUp name, logo, site design, product photography and written content belong to us or our licensors. You may not copy or reuse them commercially without permission. If you tag us in a photograph of your dog on social media, you keep ownership of it; we will only repost it with your agreement, and we will stop using it whenever you ask.
12. Using the site
Use the site lawfully. Do not attempt to break, overload or gain unauthorised access to it, scrape it at volume, or place orders fraudulently. We may suspend access if you do.
13. Our liability
We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not liable for unforeseeable loss, or for loss connected with using the product in a way this page or the product instructions tell you not to.
We do not exclude or limit liability where the law does not allow it: death or personal injury caused by our negligence, fraud, defective products, or your statutory rights as a consumer. We supply for domestic and private use only; if you use the product commercially, we are not liable for lost profit, lost business or business interruption.
14. Events outside our control
If something genuinely beyond our control delays your order, such as a courier strike or extreme weather, we will contact you and the delivery time will be extended. If the delay is substantial you can cancel and get a full refund.
15. Complaints
Email support@sitework.uk with your order number. We aim to acknowledge within one working day and to resolve within 14 days. If you paid by card and we cannot resolve it, you may also be able to raise the matter with your card provider.
16. General
We may transfer our rights and obligations under these terms to another business, and we will tell you if we do; your rights are unaffected. You may only transfer yours with our written agreement. If any part of these terms is found to be unenforceable, the remaining parts still apply. If we do not enforce a term straight away, we can still enforce it later.
We may update these terms. The version that applies to your purchase is the one published when you placed your order.
17. Governing law
These terms are governed by the law of England and Wales. You can bring legal proceedings in the English courts, and if you live in Scotland or Northern Ireland you can also bring them in your own local courts.
